Eligibility. You must be at least 18 years of age to use Loekul. By using Loekul, you represent and warrant that you have the right, authority, and capacity to enter into these Terms and to abide by all of the terms and conditions set forth herein.  

Platform Description. Loekul allows restaurants to create and manage their own advertising campaigns to promote their businesses to potential customers. Loekul also allows users to view and search for nearby restaurants and view their promotions.  

Ads and Promotions. You are solely responsible for all advertising content and promotions that you create and publish through Loekul. You represent and warrant that all such content and promotions will comply with all applicable laws, regulations, and industry standards. You also agree not to post any false, misleading, or defamatory content on Loekul.  

User Conduct. You agree to use Loekul only for lawful purposes and in compliance with all applicable laws, regulations, and industry standards. You will not use Loekul to:  

• Post any content or engage in any activity that is illegal, offensive, or that violates the rights of others 
• Transmit any viruses or other harmful code 
• Attempt to gain unauthorized access to Loekul or other users' accounts 

Intellectual Property. Loekul and all of its content and functionality, including but not limited to text, graphics, logos, images, and software, are the property of the Company and are protected by copyright and other intellectual property laws. You may not use any content or functionality from Loekul without the express written consent of the Company.  

Termination. The Company reserves the right to terminate your access to Loekul at any time and for any reason, without notice.  

Disclaimer of Warranty. Loekul is provided on an "as is" and "as available" basis. Loekul makes no representations or warranties of any kind, express or implied, as to the operation of Loekul or the information, content, materials, or products included on Loekul. Loekul will not be liable for any damages of any kind arising from the use of Loekul, including but not limited to direct, indirect, incidental, punitive, and consequential damages.  

Indemnification. You agree to indemnify, defend, and hold harmless Loekul, its affiliates, and their respective officers, directors, employees, agents, and representatives from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of Loekul or any content or promotions you create and publish through Loekul.  

Governing Law. These Terms of Service shall be governed by and construed in accordance with the laws of the state of Delaware, without giving effect to any principles of conflicts of law.
